By making a purchase on our website, or ordering from us by any means, you immediately agree that this page is a valid contract between you and Cake and Sprinkles. The information on this page may change at any time.

Consultations and Tastings

  • Consultations may be completed over the phone, email or in person. In person consultations are $30 and will take place at an agreed meeting location at an agreed upon date and time. If Cake and Sprinkles is more than 30 minutes late to the consultation, the fee will be refunded to the client. If the client is more than 30 minutes late to the consultation, the fee will be forfeited. If either party is more than 30 minutes late, the consultation is considered canceled. 
  • Tastings may only be requested for orders quoted over $300. The tasting fee is $30 per person, and will take place at an agreed meeting location at an agreed upon date and time. No more than 3 people may attend the tasting. Cake and Sprinkles will provide up to 3 flavors of cake, 3 flavors of filling and 3 flavors of icing, for a tasting event. 

Order Placement

  • Orders are to be discussed and agreed upon in writing (email invoice, hand written, etc). Order forms must be filled out for each order, and returned to Cake and Sprinkles. 
  • For your order to be confirmed, all information on the order form must be filled out and a retainer of 50% must be paid at least 3 weeks in advance of the order due date, unless otherwise agreed upon in writing. Any orders placed less than 3 weeks in advance are subject to a $50 rush fee unless not mentioned by Cake and Sprinkles. 
  • Final payment on an order must be paid at time of delivery/pick-up, unless otherwise agreed upon in writing. If the final payment is not made by the time specified, the retainer will be forfeited in full and the order will be canceled. 
  • Payment may be made by (cash, check, card, PayPal, etc) and checks shall be made out to Cake and Sprinkles or Caleb Poole. Bounced checks are subject to a $50 fee, plus reimbursement for the check amount.
  • Any items needed for the order completion, such as silk flowers, color swatches, toys, toppers, ribbon, etc are due to Cake and Sprinkles at least 2 weeks before the order due date or before an agreed time. If these items are not dropped off at least 2 weeks in advance, client agrees to delete the inclusion or use of those items from the original order.

Revision Policy

  • Revisions to an order can be made up until 1 week before the order due date at no extra fee. 
  • If revisions are requested less than 1 week before the order due date, any accepted revisions will be at the discretion and ability of Cake and Sprinkles and a $50 revision fee will apply or the difference in materials and time in Cake and Sprinkle’s discretion. Any extra monies and the $50 fee will be due the day the revision is agreed upon. 
  • Not all revisions can be accepted.

Order Pick Up / Delivery

  • Items are to be picked up at the agreed location at the EXACT time specified on the order form. 
  • PLEASE do not arrive unannounced for an early pick up. Your order may not be ready or we may not be available to help you.
  • Any pick up later than 30 minutes is subject to a $1 late fee per minute until the order is picked up. Late fee is due upon pick up before the order is handed over. If the order is not picked up within 6 hours of the original pick up time and other arrangements have not been made, Cake and Sprinkles will dispose of or donate the order and no refund will be issued to client. 
  • Delivery address and time will be agreed upon on the order form. Delivery will be prepaid at the time of the final payment on the order. Local delivery is $1 per mile away from Cake and Sprinkles, based near Scholls, Oregon, with a maximum of 60 miles. Anything further will need to be discussed with Cake and Sprinkles before order is placed.  
  • Cake and Sprinkles is not liable for any events that may occur after the product has been picked up or delivered. This includes poor handling, driving issues, heat and debris issues, acts of God, rain, human error, faulty tables or stands or any other reason out of the control of Cake and Sprinkles. Cake and Sprinkles is not obligated to fix or remedy the product due to the damages listed above, once the product has left Cake and Sprinkle’s possession. 

Delivery and Set Up

  • Client must re-verify the date/time and location of delivery with Cake and Sprinkles 24 hours before the event. If any changes have occurred, client must inform Cake and Sprinkles ASAP. If delivery distance is added after full payment has already been made, a fee of $2 per mile will be paid to Cake and Sprinkles before the order is handed over at the delivery venue.
  • There must be a client representative at the delivery location, ready to receive the item at least 15 minutes before the scheduled delivery time. If Cake and Sprinkles arrives for the delivery and no one is there to take the order, Cake and Sprinkles will wait up to 30 minutes. After that time, an additional $100 no-show fee will apply. The order may be picked up from an agreed location at an agreed upon time, and will be handed over after the $100 no-show fee has been paid.
  • If the order is to be set up or placed in a special location upon delivery, that area must be sturdy and ready for the order. If there are flowers or items to place on the cake, those items must be available, clean and ready to place. Free set up includes de-boxing the products and placing on a table. Any additional placement of items, flowers, etc is an additional $50 fee, unless otherwise agreed upon.
  • The client representative will verify the set up. Cake and Sprinkles is not liable for any issues arising at the venue after setup and verification is complete. Cake and Sprinkles will take a photograph for proof of delivery and set up. 
  • If the order is to be dropped off at a venue many hours before an event, Cake and Sprinkles suggests the iced items be placed in a cooler until 1 hour before the event.
  • If the atmosphere is very warm, above 75 degrees, Cake and Sprinkles suggests that the cake or items be kept in a cooler until 30 minutes or less before the event. Any room temperature above 75 degrees is considered too hot to keep icing stable. Client understands that a hot atmosphere may cause sweating, dripping, melting, bubbling  or falling of the icing. 

Allergen Policy

  • Cake and Sprinkles is not an allergen free bakery. We do our best to sanitize correctly to maintain allergen separation, if requested by a client. Cake and Sprinkles products should not be considered allergen free. This bakery uses common allergens: tree nuts, gluten, Red Dye #40, dairy, eggs, peanuts, etc. 
  • IT IS YOUR RESPONSIBILITY to disclose any allergies to Cake and Sprinkles before an order is placed.

Cake and Product Care

  • Cakes and desserts should never be left in direct sunlight or by a heat source. Outdoor venues should have adequate shaded and covered areas for these products.
  • If the atmosphere is very warm, above 75 degrees, Cake and Sprinkles suggests that the cake or items be kept in a cooler until 30 minutes or less before the event. Any room temperature above 75 degrees is considered too hot to keep icing stable. Client understands that a hot atmosphere may cause sweating, dripping, melting, bubbling  or falling of the icing. 
  • Cakes and other delicate items should be moved with care. When holding a cake box, hold from the bottom middle and support the entire bottom of the box. Never push on the top of the lid. When being placed in a vehicle, place on a floorboard or in a trunk where the area is flat, preferably sitting on a towel.
  • DO NOT hold a cake in your lap. 
  • DO NOT put a cake in a seat (unless you have bolstered the seat so that the cake sits perfectly flat). 
  • Leave the air in the vehicle on full blast and do no put the items by a heater or in direct sunlight. 
  • When transporting cakes, DRIVE SLOWLY AND TAKE TURNS SLOWLY. Put your hazards lights on, if necessary.
  • NEVER LEAVE A CAKE IN THE CAR.
  • Keep the cake and items away from pets, stored on a table or area they can not reach.
  • When you arrive at your venue, leave the box wrapped up and in a cool, dark place. Place the items in a fridge if at all possible, and take out 1-2 hours before the event. Only unwrap the cake and place out 1 hour before an event.
  • Cut cakes in small squares, instead of slices, to get the correct number of servings. Always cut small and let people come back for more. 
  • Wrap any leftover cake up with saran wrap or put in a covered container, and place in the fridge, to save for later.
  • Any cake or dessert with heavily colored icing may stain teeth, skin and linens. Cake and Sprinkles is not liable for any damages done by icing colors ordered by client.

Reschedule/Postpone Policy

  • If client desires to reschedule or postpone an order, Cake and Sprinkles requires a 1 week notice. If the new date is available, the order will be moved and secured. If the new date is not available, the order will be canceled and retainer returned in full. 
  • If notification occurs less than 1 week before the order due date, any monies or lost profit will be deducted from the retainer and the order will be canceled. If the new date is available, the order will be moved and extra fees will be paid the same day to re-secure the date. If the new date is not available, the order will be canceled and the retainer will be forfeited in full.
  • Quotes will be honored for up to 1 year. If the order is postponed past one year, a new quote will be delivered 3 months prior to the event and any fees owed will be due at that time.

Cancellation Policy

  • As the client, you have the right to cancel an order at any time. 
  • If you cancel the order at least 3 weeks before the order due date, you will be within the grace period and your retainer will be refunded in full. If you cancel your order less than 3 weeks from the order due date, your retainer and any other monies paid towards the order will be forfeited in full. 
  • Any deviation from this policy will be at the sole discretion of Cake and Sprinkles.

Refund Policy

  • Refunds can only be issued if the client offers photographic evidence AND the entire product is returned to Cake and Sprinkles within 24 hours of pick up.
  • Client must contact Cake and Sprinkles the same day that the order was received, and Cake and Sprinkles must be contacted before any other party or social media channel.
  • Please note you MUST take photos of any issues that you have with your order, and you MUST return the order to Cake and Sprinkles so it can be inspected. We will do our best to fix any issues or concerns. If you do not show photo evidence of issues and you do not bring the item back, no refund will be issued. All refunds are at the discretion of Cake and Sprinkles.

Liability

  • Cake and Sprinkles is not liable for issues arising from food consumed at events where Cake and Sprinkles products are being served along with other food items. 
  • If there is any concern that Cake and Sprinkles products have harmed clients or guests, the product must be returned to Cake and Sprinkles for individual inspection.
  • Cake and Sprinkles is not liable for any damage or sickness caused by mishandling of the product by the client or persons other than Cake and Sprinkles personnel.

Photo Rights

  • All orders will be photographed. These photographs are the property of Cake and Sprinkles and client will not be compensated for the sharing or printing of these images. Order images will be shared on social media and used for advertisement purposes.
